Abstract

The Code of Criminal Procedure 1973 (hereinafter referred to as the Code) provides the procedure to be adopted in cases of criminal litigations. Section 2(h) of the Code defines investigation as “all the proceedings under this Code for the collection of evidence conducted by a police officer or by any person (other than Magistrate) who is authorized by a Magistrate in this behalf. The definition of investigation is inclusive as same starts with the word includes. The reason for providing an inclusive definition of investigation is clear as the investigation cannot be watertightly compartmentalized.
